Is There Alimony in Indiana?
Alimony or spousal support is not awarded in the state of Indiana. This means a court cannot force one party to pay spousal support to the other. However, parties, through mediation or another collaboration process, can agree to pay alimony or spousal support to their ex-spouse. Additionally, Indiana courts can order what is called spousal maintenance.
Spousal maintenance is a payment from one party to the other post-divorce, and is applicable in three situations:
- If the spouse is the custodial parent of a child with a physical or mental incapacity that inhibits that spouse’s ability to work;
- If the spouse is physically or mentally incapacitated such that he/she cannot support herself/himself; or
- If the spouse is in need of rehabilitative maintenance due to a lack of education or job training.
